American 'Justice' Fails Human Rights Test

Congratulations to Gary McKinnon and the campaign in this country to block his extradition to America.

 

On 16th October British Home Secretary, Theresa May bowed to domestic pressure and medical opinion to refuse US demands for Gary McKinnon to be taken to America to answer charges, that carefully do not state that he massively embarrassed the Pentagon, whose computer security was shown to fall somewhat short of PayPal and that is his alleged "crime".

 It is widely felt in this country that the US judicial system is fundamentally unjust and it appears to be primitive, brutal and vindictive, in other words, not fit to be called proper justice at all according to the basic tenets of Common Law which include Habeas corpus as a central pillar.....whereas a common belief abroad is that the US has a judicial system that is as politically manipulated, mired in corruption and as base as the most backward banana republic in the developing world, or one of the absurd Sharia jurisdictions the US props up in the Middle East.
The suspension of Habeas Corpus has occurred before in United States history; former (and current) president(s) Abraham Lincoln, Ulysses Grant, George W. Bush, and Barack Obama have all signed the suspension of Habeas Corpus. The right has also been suspended in Britain during wartime when internment of aliens was allowed without the normal Common Law rights and safeguards. Habeas Corpus was not technically suspended by British internment in Northern Ireland during the Troubles but this is another important civil rights issue that cannot be addressed meaningfully here, but one I will try to return to in due course.

These are the real reasons why Theresa May dared not defy the overwhelming  will of the British people and could not condemn Gary McKinnon to American injustice, cruelty and officially sanctioned violence.

So she did what we have been demanding from British ministers for decades, she told the Americans no chance. She had no real choice... but in the end she speaks with the authority of the vast majority in this country.

Since the decision was announced various US politicians, lawyers and reincarnated old testament prophets have been heard in the British media venting their spleen at this perceived insult....Washington insiders have described the reaction as vacillating between incandescent and confounded.....that's fine, life's like that.... so best get over it...and stop crying over spilt milk.

Only those in a 'special relationship' such as the one that exists between our two empires and these great nations of ours blah, blah, blah ... only we 'special' friends can say this.... and Theresa May couldn't have said it more clearly, Gary McKinnon is not being extradited to America on Human Rights grounds.

That actually is a decision of the British government that is truly monumental after decades of conjoined mutuality with the US and I salute Theresa May for doing the right thing.

Refusing to send McKinnon to face trial in America, that is a country that has abolished the principle of Habeas Corpus for all political prisoners and concentration camp inmates, therefore putting itself beyond Common Law is not a safe place to send a vulnerable person. The safety of Gary McKinnon was tested, medically, legally, politically and socially and the United States has failed all the tests applied by its oldest friend, its special friend across the sea.

It is the will of the people who would never have let him go to America and of course Theresa May knows that....she is aware of the strength of feeling on this issue..... the US government may be very big in Westminster, but the British people are happily still a lot bigger.

Nevertheless, the courage to say no to the incandescent Washington law Commissars has given Mrs May a boost in prestige and it has shown consecutive Labour Home Secretaries including the current shadow Home Secretary Alan Johnson, for what they really are......whining transatlanticists.

We have heard legalistic arguments from Labour shills, but they are missing a huge point that actually they missed all the time they were in office... during the entire 13 years they colluded in war crimes and illegal invasions as Washington's pet poodles.

Johnson in an appalling attempt to appease Washington criticised the decision and he claimed Mrs May had made a decision which was "in her own party's best interests but it's not in the best interests of this country".

He doesn't say which country he is talking about but if he thinks he is talking about here he needs a reality transplant.

It takes more bottle than Mr Johnson's fellow travellers have ever shown to say no to Washington, and the reason has to be very, very big indeed ....it has to be overwhelming and it was.
Obviously there is a massive dollop of double standards here as well from a Home Secretary who earlier this month authorised a disabled man Abu Hamza to be extradited to the US, apparently after the (non-political?) Queen expressed a view that we should get rid of him. 

This is a whole set of other issues which there is no space to get into here, but the British Royals should remember 30 January 1649* the date that changed everything even if it may appear often that little has changed.....The British Royal family should soberly reflect upon their place in the grand scheme of things... before getting involved in acts of political intrigue.

But Gary McKinnon's case goes much deeper into the heart of British society and his extradition was simply impossible. Mrs May and her party are no friends of the Human Rights Act, but she was happy enough to justify her refusal to extradite on the basis of it, so who knows... maybe she has learned something from all this too? 

We can only hope so.

If Alan Johnson can't understand all that he deserves to remain in the second division of a league (i.e. parliamentarians in general) that is widely despised across the land anyway. New Labour have had to break cover on this issue and they've backed the losers...again, how dumb can one party get?

Johnson is reported to have said: "Gary McKinnon is accused of very serious offences. The US was perfectly within its rights and it was extremely reasonable of them to seek his extradition."

This rank transatlantic toadyism characterises the New Labour Quisling Years of Blair and Brown, acting as they did as US governors of Airstrip One... where British interests were betrayed and English interests were never even acknowledged in the first place.

Gary McKinnon a Scot, has had the full support of this blog and its predecessor and so it can be gratifying to find ones views echoed in the real world, which means of course that such views have made the leap from heresy to orthodoxy .... now they are part of the mainstream .

Johnson I would suggest has just lost Labour the support of many hitherto  sympathetic British voters...he is simply out of step with public opinion, which also suggests to me that Labour don't really want to be elected at all, so the kindest thing we can do is oblige them by not voting Labour again.

The Washington heavies wanted to capture a man with a learning disability - our fellow citizen, our Gary....and to torture him and inevitably kill him for embarrassing their multi-zillion dollar military industrial complex... that they so want to appear smart, worth all that debt they have created and all the tax they have collected for it.... but after Gary hacked into their computers they look like a bunch of the lumoxes incapable of looking after themselves... let alone competent to be the self-appointed guardians the Free World [sic].

Gary made those  Masters of the Universe look pretty silly and they don't like it, but who cares what they like or don't like?

They asked can 'we have him' and we answered 'no you cannot'! 

The matter is now finally concluded.

Gary and Mother Janis Sharp who over 10 years of campaigning zeal, confident eloquence and crystal clear intelligence has single mindedly propelled the campaign to stop Gary's extradition to the United States from succeeding, she has now become a prized national asset!

Not even the British government thinks the excuse for a Justice system in America has any credibility left in the world of international law. 

And it's as simple as that really, the psychopathic vengeance Washington has directed at Gary McKinnon is a symptom of the collective mental disorder that is endemic in the American judicial system, indeed it appears at all levels of government ....and incidentally it is why a failed state is currently collapsing into its own socio-economic footprint, abandoned and friendless anywhere and everywhere outside of Israel whose special relationship with the US is even more anally incestuous than ours has been.    

So there we are... a battle won, all done - Gary McKinnon will probably face trial here.... but he will benefit from a sense of proportion that to be perfectly honest makes the outcome of any future trial fairly predictable I think. Nods and winks all round here.

He got into the Pentagon computers... so well done, how very clever of him, you'd think they'd be grateful it was only Gary and not the head of THRUSH......or even our last sacrificial offering to America's judicial torture industry Mr Abu Hamza al-Mazri .....or whoever their Hollywood fantasy villain is today?

The Pentagon owe Gary one, but they also owe us all... the people of the UK... a big favour too.  Be fair!

Having made a complete fool of the US military High Command once we won't now let their own dodgy lawyers make them suffer that humiliation over and over again.  That would be cruel and unusual punishment I think and if we know about it..... we don't allow that here.... not from any quarter.

Theresa May has drawn a line under the extradition issue, there is nothing more to discuss now and so the matter is closed.

The Washington pack hounds are talking to our collective hand and not to our collective faces anymore, they need to know that nobody much is actually listening and our receiver is currently off the hook.
